Constitutional Protection for All Families

Colombia isn't just tolerant of LGBTQ+ families seeking fertility treatment — the country has constitutional and legal protections that make it one of the most welcoming destinations in the world for diverse family building.

This isn't recent or tentative. Colombia's progressive legal framework for LGBTQ+ rights has been building for over a decade, established through landmark rulings by the Colombian Constitutional Court.

The Legal Foundation

Article 13 of the Colombian Constitution enshrines the principle of equality and prohibits discrimination. The Constitutional Court has applied this principle specifically to LGBTQ+ rights through a series of landmark decisions:

⚖️

2007–2008: Equal Benefits

Three Constitutional Court rulings granted registered same-sex couples the same pension, social security, and property rights as heterosexual couples.

📜

2011: Anti-Discrimination Law

Congress passed legislation explicitly banning discrimination based on sexual orientation.

👪

2015: Adoption Equality

The Constitutional Court ruled that same-sex couples have the same adoption rights as heterosexual couples.

💍

2016: Marriage Equality

On April 28, 2016, the Constitutional Court ruled 6–3 in Sentencia SU-214 that banning same-sex marriage is unconstitutional. Colombia became the fourth South American country to legalize same-sex marriage, following Argentina, Brazil, and Uruguay.

What This Means for Fertility Treatment

Because Colombia's anti-discrimination protections are constitutional rather than just statutory, they apply broadly across all public services and private businesses — including fertility clinics. All major fertility centers serving international patients explicitly welcome LGBTQ+ patients.

Conceptum, one of Bogotá's oldest fertility clinics (founded 1988), states plainly that they have provided fertility treatment for all patients "regardless of sexual orientation, gender identity, or marital status" since their founding. InSer, Eugin, and CECOLFES all actively market their services to LGBTQ+ families.

The ROPA Method

ROPA (Reception of Oocytes from Partner) is a form of reciprocal IVF designed specifically for female couples. One partner provides the eggs, which are fertilized with donor sperm. The resulting embryo is then transferred to the other partner, who carries the pregnancy to term.

This allows both partners to participate biologically in the pregnancy — one as the genetic mother and one as the gestational mother. ROPA is available at Eugin ($10,000) and Conceptum, among others.

Practical Considerations

While Colombia's legal framework is strong, it's worth noting that social acceptance varies by region. Urban centers like Bogotá, Medellín, and Cali are significantly more progressive and welcoming than conservative rural areas. The major international-facing fertility clinics are all located in these urban centers and have extensive experience with LGBTQ+ patients from around the world.

For surrogacy specifically, Colombian law requires at least one intended parent to have a genetic link to the child. Gay male couples will need to use one partner's sperm with a donor egg. Working with experienced reproductive law attorneys is essential to navigate the court process for establishing parental rights.

Bottom line: Colombia offers something rare in the global fertility landscape — a combination of constitutional anti-discrimination protections, legal marriage equality, experienced LGBTQ+-friendly clinics, and affordable treatment costs. Whether you're a same-sex couple, single parent, or any other family configuration, you'll find both legal protection and genuine welcome at Colombia's leading fertility centers.
